In connection with the provisions of Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and the repeal of Directive 95/46/EC (hereinafter referred to as RODO), and in particular Articles 13 and 14 of the RODO, we inform you as a person who is our client (i.e. a person with whom we have concluded a contract for the provision of services or a cooperation agreement), a potential customer (i.e. a person who addresses an enquiry or correspondence for the conclusion of a contract for the provision of services or to whom we address an offer for the provision of services or cooperation) or a representative or contact person of a customer or potential customer, that:

  1. purposes and legal basis for processing your personal data
    Your personal data will be processed for the purposes of:
    a. the conclusion, performance and monitoring of a service contract concluded with the Administrator between you (as a customer or potential customer) and the Administrator, including in particular the processing of your personal data for the purposes of contact, performance of information obligations, interaction in the performance of the contract or arrangements with you, during the period prior to the conclusion of the contract and during the term of the contract – in this case, the legal basis for the processing of your data is the necessity of the processing for the conclusion and performance of the contract concluded with you or to take action at your request prior to the conclusion of the contract with you (Art. 6(1)(b) RODO),
    b. if you are not a customer, but a representative of a customer or potential customer or a contact person – verification of your identity, identification of persons entitled to represent the customer or potential customer, conclusion of a contract for the provision of services with the customer, provision of services by the Administrator and ongoing communication related to the services provided – in this case the legal basis for processing is the fulfilment of the Administrator’s legitimate interest consisting in the correct conclusion of a contract, provision of services and ongoing communication with the customer or potential customer you represent (Article 6(1)(f) RODO),
    c. analysing the performance of the Administrator’s business and creating a database of contacts for internal purposes – the legal basis for the processing in this case is the Administrator’s legitimate interest in managing customer contact and business (Article 6(1)(f) RODO),
    d. direct marketing, if you have given your consent to be contacted for marketing purposes through a specific communication channel (telephone or email) – the legal basis for processing in this case is the legitimate interest of the Administrator resulting from obtaining such consent (Article 6(1)(a) RODO),
    e. to comply with legal obligations, in particular those under tax law and the Accounting Act – in which case the legal basis for processing your data is to comply with the obligation imposed by law (Article 6(1)(c) RODO),
    f. to establish or assert possible claims or to defend against such claims by the Administrator – the legal basis for data processing in such a case is the Administrator’s legitimate interest in protecting your rights (Article 6(1)(f) RODO).
  1. Odbiorcy danych osobowych
    Państwa dane osobowe mogą być przekazywane:
    a) usługodawcom świadczącym usługi IT dla Administratora, w tym w zakresie dostarczania i utrzymania wewnętrznych systemów IT Administratora lub dostarczania usług hostingowych oraz domeny internetowej,
    b) usługodawcom wspierającym Administratora w działalności operacyjnej, w tym świadczących usługi odbioru korespondencji, usługi rachunkowe bądź inne usługi obsługi bieżącej, w tym biurowej,
    c) organom administracji publicznej (w wykonaniu obowiązków wynikających z przepisów prawa).
  2. Przetwarzanie danych osobowych w ramach EOG
    Administrator nie przewiduje przekazywania Państwa danych osobowych poza obszar Europejskiego Obszaru Gospodarczego (EOG).
  3. Czas przetwarzania danych osobowych
    W zależności od podstawy prawnej przetwarzania, Państwa dane osobowe mogą być przetwarzane przez następujący czas:
    a) jeżeli dane są niezbędne do wykonania umowy – przez okres obowiązywania umowy i następnie nie dłużej niż do momentu przedawnienia się roszczeń z nią związanych;
    b) gdy podstawą przetwarzania Państwa danych osobowych jest uzasadniony interes Administratora – do czasu zgłoszenia przez Państwa sprzeciwu, a gdy interes ten jest uzasadniony zgodą na uzyskiwanie informacji handlowych drogą elektroniczną lub na telefoniczny marketing bezpośredni, do czasu jej odwołania,
    c) gdy podstawą przetwarzania Państwa danych osobowych jest niezbędność w celu wykonania obowiązku prawnego – przez czas niezbędny dla wykonania tego obowiązku oraz przez czas wymagany przez przepisy prawa.

Okres przetwarzania danych może być przedłużony w przypadku, gdy przetwarzanie jest niezbędne do ustalenia i dochodzenia ewentualnych roszczeń lub obrony przed nimi, o okres przedawnienia roszczeń, jeżeli przetwarzanie Państwa danych osobowych będzie niezbędne dla ustalenia lub dochodzenia ewentualnych roszczeń lub obrony przed takimi roszczeniami przez Administratora, a po tym czasie jedynie w przypadku i w zakresie, w jakim będą wymagać tego przepisy prawa.

  1. Kategorie oraz źródło pochodzenia danych osobowych
    Administrator przetwarza dane osobowe podane bezpośrednio przez Państwa, tj. w związku z art. 13 RODO, jak również dane osobowe pozyskane od osób, które reprezentują Państwa podczas korzystania z usług lub innego rodzaju kontaktu z Administratorem, Państwa współpracowników lub innego personelu tj. w związku z art. 14 RODO.
    W zależności od tego, jakie dane osobowe zostały nam przekazane, możemy przetwarzać w szczególności następujące kategorie Państwa danych osobowych:
    a) dane identyfikacyjne (np. imię i nazwisko, firma, NIP),
    b) dane kontaktowe (adres siedziby lub zamieszkania, adres e-mail, numer telefonu, adres korespondencyjny).

7.Your rights
Where we process your personal data on the basis of a legitimate interest of the Controller, including for direct marketing purposes, you have the right to object to the processing of your personal data. Objecting means that we will no longer be able to process your personal data from the moment the objection is raised.
To the extent provided for by the relevant legislation, you have the right to:
(a) to access the personal data we process, including to obtain a copy;
(b) to request the rectification or completion of your personal data;
(c) have your personal data erased (where provided for under the RODO);
(d) to restrict the processing of your personal data;
(e) portability of your personal data, i.e. to receive personal data from the controller in a structured, commonly used machine-readable format which you can send to another controller, but only if that personal data is processed on the basis of your consent or for the performance of a contract;
(f) the right not to be subject to a decision based solely on automated processing. You also have the right to lodge a complaint with a data protection supervisory authority if you consider that the processing of your personal data violates the provisions of the RODO. The supervisory authority in the Republic of Poland is the President of the Office for Personal Data Protection.

8. Voluntariness of providing data
Providing your personal data is voluntary, however, it is necessary in order to conclude and perform the contract, to present an offer to provide services, to verify your identity, to identify persons entitled to represent a client or potential client, to conduct ongoing communication related to the Administrator’s services. Refusal to provide personal data will result in the impossibility to conclude or perform a contract or conduct ongoing communication related to the Administrator’s services provided.

9. No profiling or automated decision-making

The Administrator does not carry out automated decision-making or profiling.
